Counter Offer?

Rod Heller flew in today and signed "a" contract for the sale of the CCOF. I say, "a" rather than "the" contract so as to avoid any confusion that may arise from the natural assumption that Mr. Heller would sign "the" contract previously approved by the BOMA.

Mr. Heller signed "a" contract for the sale of the CCOF property for the same price as before, $5M. The "counteroffer" contract is somewhat different, however, than the contract approved by the BOMA.

First, the "counteroffer" relieves Mr. Heller of the beaver burden. If the beavers are to be removed, it will be the city doing it.

Second, there is no reference to a lease to Carnton in the counter offer contract Mr. Heller signed today.

Finally, the counteroffer contract has the closing costs split between the parties.

I wonder if I'll ever see the counter offer contract or not.

Anyone know where I can get a politically correct pizza around here?

Ya know it seems like the same ol song and dance--I mean what's the point? Does this mean the "counteroffer" is null and void? Does the Mayor realize that there even is a BOMA? Doesnt Mr. Heller realize that beavers are people too? If he signed this contract then why.....nevermind..eech

How I love counteroffers!

To respond to hellernot, basically, the counteroffer destroys the original offer ... and of course, indicates an unwillingness to be bound.

Anyway, Dana, I'm telling you, if the city takes on the responsibility for the beavers and environmental concerns, you may as well start a Beaver Subcommittee.

You don't want that mess - people will be walking around in hip waders monitoring the dams and wetlands for years.

Heller should have to deal with them - just like any realty deal, where the owner is responsible for a multitude of tasks prior to closing.

Doesn't the counter offer have to be approved by the BOMA in order to be legal? Will the City's half of closing costs be published? Is the 20 gauge coming out of the gun case?

Gee... wonder where Heller got the idea that he might be able to push the beaver responsibility off onto the city? Maybe from 3 of the aldermen and their brilliant idea!!!

According to your 11/17 post: Does removing the lease from the contract mean BOMA no longer needs to approve anything regarding the contract?

Does anybody else remember the snail darter mess in Columbia? When (not if, I'm certain) the city takes on the beaver problem, the beavers will win, and the City of Franklin will then be the proud owners of Beaver Park.
